Drift Away Campers Ltd. Terms & Conditions for Vehicle Hire

 

1. Definitions

 

‘The Vehicle’ = The 2013 (Poseidon) or 2015 (Atlantis) VW Transporter T5.1 Camper Van

‘This Agreement’ = Drift Away Campers Ltd. Terms and Conditions

‘Rental Agreement’ = Document listing terms of rental which hirer must adhere to and sign when collecting the vehicle

‘The Customer/Hirer’ = The person or persons signing this agreement

‘Security Deposit’ = €1,000 which is equal to the insurance excess fee

 

The following are the General Terms & Conditions of Hire between the Hirer and Drift Away Campers Ltd. Note that these Terms together with the Drift Away Campers Ltd. completed Booking Form, Copies of the Drivers Licence and Proof of Address (requested at the time of booking) and the Insurance Motor Rental Agreement signed upon collection of the vehicle combine to form the rental agreement. The campervan and its equipment remain the property of Drift Away Campers Ltd. at all times.  All payments made to Drift Away Campers Ltd. shall be in Euros. 

 

Drift Away Campers Ltd. VW Campervan Hire is for the 32 Counties of the Island of Ireland only and they cannot be taken to mainland UK or Europe.  Any attempt to bring the VW Campervans off the Island of Ireland will invalidate your contract with us and your booking will be cancelled and will result in automatic forfeit of your security deposit and application of any other costs involved in the repatriation of the vehicle.

 

2. Reservations/Bookings

A reservation with Drift Away Campers Ltd. is only complete when the following has been received by Drift Away Campers Ltd. and acknowledged with a confirmation of booking email:

 

  • Signed Booking Form,

  • Booking deposit of €300 made by Credit or Debit Card via the secure SOTpay Payment System.

  • Copy of driver/s licence and proof of address (a Utility Bill dated within 3 months and with the matching address of Driver’s Licence)

 

The hirer shall receive a Booking Email containing the rental and payment details and a checklist of required documents. Confirmation emails will be issued upon receipt of booking deposit and documentation.  Drift Away Campers Ltd. can facilitate reservations for hirers without internet access. For further details, please contact Amanda Jane on +353 (0) 851448997.  All rental charges are to be paid in full by transfer, credit or debit card 28 days before the first day of hire.

3. Driver Age and Driver’s Licence Requirements

  • All drivers must be aged between 25 and 70.

  • Have held a full clean licence for at least two years.

  • The rental prices quoted on our website and literature include insurance cover for one Irish, UK or European named driver aged between 25 -70 years, with a clean licence.  An additional driver may be added at an additional cost.

  • US and Canadian licences must be held for a minimum of 8 years and EEA licences a minimum of 5 years.

  • In order to comply with the requirements of our Insurance Company all drivers must disclose full details of any indorsements or accidents within the last 5 years.

  • Any additional surcharges due to, for example: non-EU licence, driver’s age, high-risk occupation, history of endorsements within the last five years, history of accidents, physical/mental defects, refused motor insurance record and motor convictions, additional drivers, etc. will be advised by Drift Away Campers Ltd. and any additional costs will be payable as part of the rental fee.

  • All drivers must submit copies of their full drivers' licence at booking stage.

  • Drivers are required to present their drivers licence on the day of hire. Please note that if these documents are not available, Drift Away Campers Ltd. will be unable to proceed with the Hire as they are governed by their insurance company’s requirements.

  • At booking stage, we must receive confirmation of address in the form of a recent utility bill (not older than three months) or a bank/building society statement that matches the address on the driving licences.

  • UK drivers must submit copies of both their photo card and paper counterpart licences.

  • Hirers from outside Ireland and the UK must also submit copies of a valid passport or identity card as proof of id.

 

4. Insurance and Stipulations

 

Fully comprehensive insurance is provided by Drift Away Campers Ltd. to the driver(s) named on the Booking Form. Drift Away Campers Ltd. campervans may only be driven by the Hirer and/or agreed additional Drivers who have been accepted by Drift Away Campers Ltd. and their Insurance Company.  All named Drivers must be over 25 and under 70 years of age and have held a full licence for at least two years.

Drift Away Campers Ltd. VW Campervan Hire is for the 32 Counties of the Island of Ireland only and they cannot be taken to mainland UK or Europe.  Any attempt to bring the VW Campervans off the Island of Ireland will invalidate your contract with us and your booking will be cancelled and will result in automatic forfeit of your security deposit and application of any other costs involved in the repatriation of the vehicle.

 

Drivers are required to present their drivers licence on the day of hire. Please note that if these documents are not available, Drift Away Campers Ltd. will be unable to proceed with the Hire as they are governed by their insurance company’s requirements.


The Hirer is insured for damage to the campervan and third-party damages. In the event of any damage to the vehicle or third party the Hirer will be responsible for the insurance excess of €1000 per case not rental. Failure to declare an incident or accident is a criminal offence punishable by law.  It is illegal to drive without insurance in Ireland & UK. Driving by an unauthorised driver invalidates the insurance.
 

The theft of a campervan is not covered by insurance if the keys are left in the ignition or the surrounds of the campervan while the campervan is unoccupied and the hirer shall be fully responsible for the cost of a replacement campervan.


The hirer is accountable for the following items not covered by Drift Away Campers Ltd. insurance:

 

  • Windscreen, Tyre/Wheel damage.

  • Loss/damage/theft to the radio, stereo equipment, Wi-Fi equipment and aerials.

  • Damage to interior units and/or equipment.

  • Damage to the Pop-Top Roof caused by neglect and/or driving with this up or attempting to drive under height restricted barriers (i.e. car parks, multi-storey carparks).

  • Personal effects within or from the campervan.

  • Any damages below the value of the €1000 excess where no third party can be held accountable.
     

5. Obligations of The Hirer and/or Drivers
 

Fully comprehensive insurance is provided by Drift Away Campers Ltd. to the driver(s) named on the Booking Form. Drift Away Campers Ltd. campervans may only be driven by the Hirer and/or agreed additional Drivers who have been accepted by Drift Away Campers Ltd. and their Insurance Company. The insurance will be invalidated where the van is driven off-road or on unsurfaced roads and damage is caused to the underside of the vehicle or is driven without due care and attention, negligently, recklessly or where the driver is under the influence of alcohol or other drugs.


The hirer is accountable for the following items not covered by Drift Away Campers Ltd. insurance:

 

  • Windscreen, Tyre/Wheel damage, Damage to the Underside of the Vehicle.

  • Loss/damage/theft to the radio, stereo equipment, Phone Kit.

  • Damage to interior units and/or equipment.

  • Damage to the Pop-Top Roof caused by neglect and/or driving with this up or attempting to drive under height restricted barriers (i.e., car parks, multi-storey carparks). Each Campervan has a height of 2.1 metres with the roof fully down and this is shown as a reminder to drivers on the sun visor above the driver’s seat.

  • Personal effects within or from the campervan.

Any damages below the value of the €1000 excess where no third party can be held accountable.
 

6. Drift Away Campers Ltd. Obligations

 

a. We have maintained the vehicle to a high standard to ensure to the best of our ability that the

vehicle is roadworthy and suitable for renting at the start of the rental period. We will show you

how to use the vehicle, answer any questions you have before you depart and go through this

Agreement with you before you are expected to sign it.

 

b. In the event that your vehicle is unavailable for reasons out of our control, such involvement in an

accident or serious mechanical fault, prior to your agreed Vehicle collection time, we will endeavour to

provide a replacement vehicle. If a replacement vehicle is unavailable then we will refund all

monies including your initial booking fee of €300.


7. Rental Period

 

You will have the vehicle for the rental period shown on your rental agreement. The rental period will be shown with time and date of departure and the required time and date of the return of the vehicle. If you do not bring the vehicle back on time you are breaking the conditions of this agreement. If the campervan is returned late, outside the times agreed, Drift Away Campers Ltd. reserves the right to charge the hirer at a rate of €50 per hour together with any additional costs incurred by Drift Away Campers Ltd. (e.g. compensation to the next Hirer).

 

8. Security Deposit

 

The Security Deposit is a refundable deposit and covers both any insurance excess that may be payable and the proper return of the Camper in the same condition as it was let out to the Hirer.
Drift Away Campers Ltd. requires a security deposit of €1000 for each rental. The security deposit is payable within 1 week of commencement of hire.  A credit/debit card is used for the purposes of holding the security deposit and is paid through the secure SOTpay Payment system. Please ensure that there are sufficient funds for the security deposit. 

 

The Security Deposit is taken as security to cover the possibility of damage, whether negligent, wilful, accidental or otherwise, loss to the van or the fixtures and fittings therein or the living equipment and windows, wheels, tyres, underside, roof etc included with the van.

 

The customer must irrevocably authorise Drift Away Campers Ltd. to deduct from the Security Deposit any amounts due by the customer to Drift Away Campers Ltd. arising out of this Agreement.

The security deposit will be refunded within 14 days of the vehicle being returned on time, to the correct location, undamaged, with a clean interior, a full fuel tank and with all equipment in place and intact and all tolls and fines paid. 

 

We reserve the right to retain a €100.00 valeting fee if the Campervan is not returned with the interior in a clean condition.  The security deposit is held for up to 14 days to ensure that all tolls and parking or speeding fines 

are paid.

 

The remainder of this security deposit will be returned to the hirer once the damage/loss has been paid for so long as the following is confirmed:

 

  • No damage to the camper, including windscreen or tyres, or any third party.

  • No smoking has occurred within the Campervan.

  • No malfunction, breakdown or repairs caused by the negligence of the hirer.

  • The hirer is required to check the water and oil levels in the engine and tyre pressures.

  • Camper is returned to the agreed location, on the agreed date and time.

  • Camper is refuelled to a full tank of fuel.

  • Vehicle and contents are returned in the same condition as collected, the interior cleaned including all cooking utensils and camping equipment where applicable.

  • No additional cleaning required due to the carriage of pets.

  • No additional costs have been incurred during the period of rental, e.g.: violation of traffic laws or regulations.

  • The camper has not been driven by anyone other than those named in the Insurance Motor Rental Agreement.

  • The hirer agrees to pay Drift Away Campers Ltd. any additional costs over and above the security deposit value should damages exceed the security deposit value.

  • Drift Away Campers Ltd. reserves the right to increase the security deposit for specific events e.g.: festivals, rallies or promotional events.

 

9. Price and Payment

 

Payment shall be made by Credit Card or Deboit Card though the secure SOTpay Payment system.  All rental charges are to be paid in full by transfer, credit or debit card 28 days before the first day of hire.

 

When paying by credit card customers must agree to the following:

 

a. Drift Away Campers Ltd. is authorised to complete any documentation and to take any other action to recover from the customer’s credit card issuer all amounts due by the customer in accordance with this Agreement, including but not limited to, any amounts due in respect of damage to the Vehicle or to property of a third party and all other additional charges as they are incurred (including all parking and traffic infringement penalties and associated administration costs).

b. Customers will not dispute their liability to Drift Away Campers Ltd. for any amount due under this agreement and shall indemnify and keep indemnified Drift Away Campers against any loss incurred (including legal costs) by reason of notifying my credit card issuer of such dispute.

c. In the event that Drift Away Campers Ltd. elects to accept payment of the Security Deposit by holding an open security payment which will be cancelled at the completion of the Rental Period, the customer must agree that Drift Away Campers Ltd. is entitled to recover payment from their credit card in respect of any amounts due which were not known at the time of cancelling the open security payment.

d. All transactions under this agreement are conducted in Euro. Due to exchange rate fluctuations, there could be some variance between the amount initially debited against credit cards and the amount refunded within 14 days after the expiration of the rental period. The customer must release Drift Away Campers Ltd. from any liability for such variation.

 

The price of the camper shall be the price set out in each detailed in the rental agreement as.  The payment for the rental includes the following and those items specified on each Camper Van Kit List:

 

  • Fully Comprehensive Insurance for one driver aged 25-70

  • Breakdown Assistance

  • Vehicle demonstration on collection

  • 2 Ring Gas Hob

  • Cooking Utensils: Kettle, Pots, Frying Pans, Crockery, Cutlery, etc

  • Camping Gas

  • Fridge

  • Sink with pumped cold water

  • 12v Leisure battery (charging of phones etc), 240v cable electric hook-up (Campsite)

  • Van safety equipment, Fire extinguisher, Fire blanket, first aid kit, carbon monoxide alarm.

  • Complimentary Bedding for 2 Guests.

 

10. Fuel Policy

 

All vehicles are supplied with a full tank of fuel at the start of the hire. Customers must return the vehicle with a full tank of fuel. Customers that return the vehicle with the fuel tank either empty or part full will be charged for the missing fuel at the end of the rental at the locally determined price, along with a fuel collection fee of €15.  This can either be deducted from the Security Deposit or paid up-front.  The hirer is responsible for any costs involved in the refuelling of the vehicle with incorrect fuel. All our vehicle use road diesel.

 

11. Violation of Traffic Laws and Regulations


Driver(s) are personally liable for all legal penalties and fees pertaining to any traffic violation infringements under the current Road Traffic Legislation applicable in the Republic of Ireland or Northern Ireland. The driver(s) are also responsible for any payment of tolls including M50 charges.  The driver(s) will be liable for any penalties and fees received during their rental.  Drift Away Campers Ltd. will hold your credit card details for up to 14 days after the rental agreement finishes in case any traffic violation infringements are presented to Drift Away Campers Ltd. for your hire period.  Drift Away Campers Ltd. will notify the driver(s) of any speeding or parking fines and an administration charge of €25 for each infringement incurred throughout the hire period.

12.  Breakdown

 

If you have any difficulties, please report these immediately to Drift Away Campers Ltd. by telephone.
In the event of breakdown 24-hour roadside assistance.  Minor repair bills up to the value of €125 will be reimbursed by Drift Away Campers Ltd. upon production of receipts. Repairs in excess of this amount must first be authorised by Drift Away Campers Ltd. PRIOR to the work being undertaken.


In the rare case of a breakdown that cannot be repaired the breakdown company will tow the vehicle and occupants to a local garage.


The Hirer should never engage the help of a third-party mechanic or any other repairs person without first contacting Drift Away Campers Ltd. Failure to contact Drift Away Campers Ltd. may result in the loss of any refunds due as a result of breakdown.

 

Drift Away Campers Ltd. cannot accept liability for any costs arising from accident, breakdown or any other cause, e.g., replacement vehicle costs, travel, accommodation. Drift Away Campers liability extends to refunding your hire charge for any days you lose the total use of the vehicle.  A full day consists of a 24-hour period from the time of Drift Away Campers Ltd. notification of breakdown.

 

The Hirer will be liable for any costs associated with the incorrect use of fuel (fuel being diesel or petrol).

 

13. Accidents

 

In the event of an accident and or loss or damage arising out of the use of the Vehicle you must:

 

a. Notify Drift Away Campers Ltd. within 12hrs of the accident.

b. Obtain the names and addresses of third parties and any witnesses and report the event to the

Gardai.

c. Obtain the insurance details of third parties, third party vehicle registration and where possible

take photos of the incident.

d. Make no admission of liability to other parties; settlement offer or other like offer.

e. Assist Drift Away Campers Ltd. in handling any claim arising from any event, including providing all

relevant information and attending Court to give evidence if required.

f. Acknowledge that the excess or other amount due by me in respect of any damage arising from

an accident, loss or damage is payable at the time of reporting the event and not at the completion

of the rental period.

 

In case of an Accident please take the following steps:

 

  • Note the name and address of the other driver and the vehicle owner, if different

  • Note the name and address of each witness

  • Describe any injury to yourself or others

  • Describe damage to vehicles and other property

  • Note the name and address of the other driver’s insurance company (See insurance disc on windscreen)

  • Note the number of certificate of insurance (See insurance disc on windscreen)

  • Note the registration number of other vehicle/s

  • Note the name or Number of any Garda at the scene or any AA patrol attending

  • Note the date, time and location of accident

  • Note the speed of vehicles involved

  • Note the width of road, road markings, state of road surface, weather conditions, visibility, time of day

  • Describe the debris or marks on the road relevant to the accident

  • Describe the manner of other driver’s driving

  • Draw a rough sketch of vehicle positions before and after the accident

  • Note whether other driver and passengers were wearing seatbelts

  • Take photographs of the scene if you have a camera

  • Inform the Garda (Police in Republic)/ Police Service Northern Ireland (PSNI) and obtain an Incident or Crime Number.

 

14. Terminating the Agreement

 

The customer acknowledges that Drift Away Campers Ltd. may terminate this Agreement and repossess the Vehicle at any time, without notification to the customer, and that the customer will pay the reasonable costs of repossessing the Vehicle, including towing charges if:

 

a. They are in breach of any term of this agreement.

b. They have obtained the Vehicle through fraud or misrepresentation.

c. The Vehicle appears to be abandoned.

d. The Vehicle is not returned on the agreed return date or Drift Away Campers Ltd. reasonably believes that the Vehicle will not be returned on the agreed return date.

e. Drift Away Campers Ltd. considers, on reasonable grounds, that the safety of passengers or the condition of the Vehicle is endangered.

f. The customer understands that in the event of such termination or repossession, they have no right to a refund of any part of the rental charges or the Security Deposit.

g. Drift Away Campers Ltd. VW Campervan Hire is for the 32 Counties of the Island of Ireland only and they cannot be taken to mainland UK or Europe.  Any attempt to bring the VW Campervans off the Island of Ireland will invalidate your contract with us and your booking will be cancelled and will result in automatic forfeit of your security deposit and application of any other costs involved in the repatriation of the vehicle.

 

Drift Away Campers Ltd. reserve the right to cancel a reservation at the proposed commencement of hire if:

  • Required documents are not produced or valid in accordance with stated conditions.

  • Failure to provide funds for security deposit.

  • Over occupancy of campervan.

  • Address on driving licence does not match booking/billing address. Additional proof of id is required in the form of a recent utility bill or a bank/building society statement.

  • Hirers from outside Ireland and the UK fail to provide a valid passport or national identity card alongside driving licence as proof of id.

 

Drift Away Campers Ltd. reserve the right to refuse to hire to any person, without stating cause.

15. Cancellation Charges

 

a. The booking deposit of €300 is non-refundable.

b. If cancellation is within 28 days of the first day of hire, the customer will not be entitled to a refund.

c. In the event of cancellation, booking deposits are not transferable to alternative hire dates.

d. If appropriate identification and/or the necessary payment/deposit are not produced at the time the Vehicle is to be collected or the Terms and Conditions are not adhered to in any way then the rental cannot proceed and the cancellation policy will be enforced.

e. Cancellations may only be made by contacting Drift Away Campers Ltd. by phone or in writing.

f. In the event that your vehicle is unavailable for reasons out of our control, such as the vehicle has been involved in an accident prior to your agreed collection time of the vehicle, then we will endeavour to have a replacement vehicle in place. If a replacement vehicle is unavailable then we will refund all monies including your initial booking fee of €300 and Drift Away Campers Ltd. will be not be held responsible for matters outside of their control.

g. Credit card and debit card charges are non-refundable. It is advisable to purchase holiday cancellation insurance.

 

16. Collection & Return

 

Pick up and drop off is at our location at The Railway Cottage, Mullanboys, Inver, County Donegal F94 R3P9.

 

The Vehicle will be issued in a clean condition and in sound working order in accordance with the Departure Checklist and with a full fuel tank (the Rental Agreement will be produced for signature prior to departure).  The Hirer will adhere to the collection and/or delivery and return times shown at the end of the Hire Agreement.

 

The vehicle must be returned in a clean condition, externally and internally, with a full tank of fuel by the time specified on the final day of hire as specified in the Hire Agreement.

 

Drift Away Campers Ltd. will not refund any monies and are under no obligation to provide a replacement vehicle if the Vehicle is returned or the hirer ceases to have the use of the Vehicle prior to the return date for any reason including accident, damage, weather and theft. The breakdown or malfunction of equipment after the vehicle has left the premises will not be accepted as reason to abort or cancel the Rental Agreement, and any such fault will be rectified as soon as possible.

 

If the campervan is returned late, outside the times agreed, Drift Away Campers Ltd. reserves the right to charge the hirer at a rate of €50 per hour together with any additional costs incurred by Drift Away Campers Ltd. (e.g. compensation to the next Hirer).
 

Upon return a Drift Away Campers Ltd. representative will check the campervan for damage, cleanliness, a full tank of fuel, condition of the tyres, windscreen, bumpers, roof lights, mirrors, doors and internal habitation equipment.


Drift Away Campers Ltd. will make the following charges for additional cleaning:

  • €100 for the cleaning of stained upholstery.

  • €100 for a very dirty interior.

  • €100 if the no smoking clause has been ignored.
     

Drift Away Campers Ltd. campervans must never be taken through a car wash, or washed using a pressure wash on the paintwork. Should this be ignored, damage to paintwork and the resulting costs incurred by a specialist body shop shall be passed on in full to the Hirer.

 

Please allow for at least 1 hour for the collection and return of your vehicle to complete necessary Vehicle checks and paperwork.

 

An inventory of the equipment necessary for you to enjoy your holiday will be furnished and checked with you at the start and the end of the hire period.

 

17. Personal Car Parking & Storage

 

The parking of two cars per rental will be provided by Drift Away Campers Ltd. Storage of luggage is also available if booked in advance. Both parking and storage shall be entirely at the hirer’s own risk and you will be asked to sign a disclaimer to this effect.

 

18. Release and Indemnity of Drift Away Campers

a. Subject to its obligation to deliver the Vehicle or an appropriate substitute vehicle, the customer must release Drift Away Campers Ltd. from any liability to the customer (regardless of who is at fault) for any loss or damage incurred by the customer by reason of this Agreement, including but not limited to:

  • Any loss or damage caused by breakdown, mechanical defect, accident or the Vehicle being unsuitable for the customer’s purpose.

  • Any loss or damage to any property left in or on the Vehicle or in Drift Away Campers’ Ltd. premises or recovered or handled by Drift Away Campers Ltd.

 

b. Subject to any insurance arrangements agreed with Drift Away Campers Ltd., I hereby indemnify and shall keep indemnified Drift Away Campers Ltd., its employees and agents against any claims, demands and expenses (including legal costs) incurred or sustained by them or any of them by reason of my use and/or possession of the Vehicle.

 

19. Rental Agreement

The customer will be asked to sign a Rental Agreement upon collection of the vehicle. The Rental Agreement must be signed before a customer can depart so, please review this prior to your departure.

 

20. Privacy Policy

 

a. During the enquiry and reservation process Drift Away Campers Ltd. will collect personal information, including but limited to, your name, e-mail address, postal address and telephone number. This information is necessary for booking and for insurance purposes. We may use this information to notify you of any news you may be interested in regarding Drift Away Campers Ltd.

 

b. None of your personal information will be passed on to any third-party companies (other than the insurance company that Drift Away Campers Ltd. uses or to Gardai or other State or Semi-State Bodies). Payment details including credit and/or debit card numbers, card expiry date and security code will be processed through the secure SOTpay system.

 

21. Hireable Extras

 

Other hireable extras are available at additional cost as outlined on our Website.  These are charged for the duration of the hirers stay in a campervan.

 

A camping gas canister will be included in the rental of the Campervan.  Additional gas purchased throughout the rental period is at the customer’s own expense and the physical bottle containing the gas remains the property of Drift Away Campers Ltd.  A like for like replacement canister must always be sought when replacing gas.

 

22. Pets

 

Pets are not allowed.

23. Covid-19 Affected Bookings

1. If due to government restrictions in the Republic of Ireland, you have made a booking and it is not permissible to travel either outside a specific distance or County and this affects your booking, then you may reschedule your booking to a future date (if available) or we offer a full refund.  The same will apply if the restriction affects a hirer from Northern Ireland.

2. If domestic travel is permissible and yet you or one of your travelling party find that you have:

a) Contracted Covid-19 within 14 days of your travel dates;

b) Been determined that you are a close contact of a person who has Covid-19 with 14 days of your travel dates;

then Drift Away Campers Ltd. will allow you to reschedule your booking to a future date (if available) or we offer a full refund.
